RBI Revises Loan Recovery Rules: New Norms From January 2027

Reserve Bank of India (RBI) has introduced a common framework that makes stronger guidelines about loan recovery procedures and dealing with the customers. The central bank released nine circulars on August 6, 2026, which are part of the revised recovery framework. The new guidelines will be implemented from January 1, 2027, instead of October 1, 2026, which is the earlier proposed implementation date that was postponed to allow lenders more time to prepare for implementation.

What are RBI’s Loan Recovery Rules?

The revised framework intends to introduce consistency in the loan recovery process followed by the regulated lenders.

The loan recovery includes interacting with those borrowers who have not made the payments and may involve calls, messages, and visits by recovery agents.

This new framework sets boundaries for all these things in order to ensure that recovery needs of the lenders are met in a fair way.

The framework is applicable from January 1, 2027.

New Timing for Recovery Calls and Physical Visitations

Firstly, one of the changes is the timing of recovery calls.

According to the new guidelines, all recovery calls and visits by the recovery agent can only take place between the hours of 8:00 AM and 7:00 PM.

This will give a fixed timeframe when the recovery activities are expected and does not allow recovery activities to take place at any other time other than that specified above.

Furthermore, the new guidelines make it compulsory for the lenders to give prior notice before any recovery visitation is made.

The lenders must give at least a one-day prior notice to the borrower before making the first physical visit by the recovery agents.

In this way, the borrower will get prior information regarding the visit.

Record Keeping of Recovery Calls

In addition to the above-mentioned changes, the RBI has also increased the requirement for documentation of recovery calls.

According to the new guidelines, the lender must keep the recordings of recovery calls for at least six months.

New Locking Rules for Financed Devices

  • The newly proposed regulations also cover the usage of technology to lock remotely financed devices.
  • This mainly pertains to devices like mobile phones and tablets that are bought via financing.
  • According to the new regulation, the lender should not remotely lock any financed device before 30 days of overdue payments.
  • The complete lock of the device is allowed only after 60 days of no payment.
  • Thus, the newly proposed framework puts a restriction in terms of time before lenders can use remote locking technology.

Essential Features Should Stay Active

Even after financing the device is locked, some features must stay active.

A locked device shall allow the following features to work,

  • Calls
  • SMS
  • SOS emergency services

The above requirement becomes especially significant as a mobile phone may be required during emergency situations.

The above regulation ensures that the device does not lose all its functions during device restrictions due to recovery measures.

Certification for Recovery Agents Required

Under the revised guidelines, there is the question of the certification of recovery agents.

Under the framework, recovery agents should get certified by the Indian Institute of Banking and Finance (IIBF) prior to hire.

Recovery agents are commonly used by financial institutions and banks to contact borrowers about their overdue loan and facilitate its recovery.

Certification requirements are made to make sure that people who conduct recovery are qualified and comply with required professional standards.

Why Has Implementation Been Deferred?

As per the revised directions, the implementation date has been shifted to January 1, 2027, as opposed to October 1, 2026 as was initially planned.

More time is being given to lenders to adjust their procedures of communication and align recovery policies and procedures with the new regulations.

The lenders which were earlier exempted from some requirements also got the transition period starting from January 1, 2027 and lasting one year.

Why Are the Revised Guidelines Important?

The process of loan recovery is often sensitive as at the moment of account being overdue borrowers face financial problems.

Clear rules of recovery communication can provide predictable standards for both borrowers and lenders.

The use of technology in recovery processes like remote device locking is also regulated under the framework.

This combination of communication rules, documentation, certification and technology helps to build up recovery ecosystem.

RBI and Regulations for Loan Recovery

The Reserve Bank of India is the central banking and financial regulatory body of India. The RBI regulates banks and NBFCs amongst others through its legal framework.

The RBI was incorporated in the year 1935 and it was nationalized in 1949.

The Reserve Bank of India Act, 1934 is the statutory backing of the central bank.

The loan recovery directions, thus, are a part of the overall regulatory strategy of the RBI.
