The Vice President of India is one of the highest constitutional authorities in the country. The Vice President of India is the second-highest constitutional office in the nation, just after the Parliament. The position was created under Article 63 of the Indian Constitution.

Method of Election

The Vice President is elected not directly by the people but by an Electoral College.

This Electoral College consists of :

  • Members of both Houses of Parliament (Lok Sabha and Rajya Sabha).
  • Voting is conducted by the single transferable vote system through secret ballot.

Key Point: Unlike the election of the President, the State Legislative Assembly do not take part in the Vice President’s election.

Qualifications for Becoming the Vice President

To be eligible for the post, a person must:

  • Be a citizen of India.
  • Be at least 35 years old.
  • Be qualified to be elected as a member of the Rajya Sabha.
  • Must not hold any office of profit under the Government of India, any State Government or any public authority.

Term of Office and Removal

  • The Vice President holds office for a term of five years.
  • They can resign at any time by submitting a resignation letter to the President.
  • The Vice President can also be removed by a resolution of the Rajya Sabha passed by a majority of its members and agreed to by the Lok Sabha.

Ex-Officio Chairman of the Rajya Sabha

One of the most important functions of the Vice President is to act as the Chairman of the Rajya Sabha (Upper House of Parliament).

As Chairman, the Vice President:

  • Presides over Rajya Sabha sessions.
  • Ensures orderly conduct of business in the house.
  • Decides on points of order and maintains discipline during debates.
  • Does not vote in the house expect in case of a tie.

Acting President of India

If the President is unable to discharge their duties due to illness, absence, resignation, death or removal, the Vice President acts as the President of India until a new President is elected.

During this period:

  • The Vice President has all the powers and functions of the President.
  • They act as the symbolic head of state and perform ceremonial duties.

Ceremonial and Diplomatic Duties

  • Represents India at official events in the absence of the President.
  • Meets with foreign dignitaries visiting India.
  • Can attend international conferences and summits.

Limitations of Powers

While the Vice President holds a high-ranking office, their powers are largely limited to parliamentary functions and acting as President in special circumstances. They do not have the same executive powers as the Prime Minister or President in normal conditions.
