Supreme Court Rules That Religious Conversion Does Not Automatically Preserve Backward Class Reservation
Supreme Court of India has decided that an individual who changes his/her religion from Hinduism to Islam will not be entitled to backward class reservation based on their cast/communal identity after their conversion. In its order passed on 15th October 2026, a bench comprising of Justices Prashant Kumar Mishra and Shree Chandrashekhar disposed off of a plea filed by the Tamil Nadu government against a 2024 High Court verdict.
The Supreme Court confirmed the Madras High Court’s judgment that a convert to Islam could not get reservation benefits in respect of Tamil Nadu’s Backward Class (Muslims) list on account of his being a member of any backward community or caste prior to conversion.
It was stated by the Bench that social backwardness which is related to one social order does not carry over to another one post conversion. Conversion alone does not make one a member of any backward class community notified.
In 2024, the Tamil Nadu government passed an order that allowed those who converted themselves into the religion of Islam to be regarded as the Backward Class (Muslim) and get their community certificate among the seven notified Muslim sects for the purpose of reservation.
It included those people who belonged to the following classes prior to their conversion,
It has been held by the Madras High Court that the order passed by the government is unconstitutional and it has been quashed. The Tamil Nadu government later moved to the Supreme Court against this order and contended that the people who were socially and educationally backward should not be deprived of reservation just because of change of religion.
Article 16 of the constitution ensures equality of opportunity in matters relating to public employment. Article 16(4) enables the state to make provisions for the reservation of appointments or posts in favor of a backward class of citizens who are not adequately represented in the state services.
This judgment revolves around the constitutional provision on the basis of which one can get entitlement to reservation in case of change of religion in the notified backward class category.
| Constitutional provision | Importance of constitutional provision |
| Article 14 | Safeguards equality before law and equal protection of the laws. |
| Article 15(4) | Authorizes the making of special provisions for the advancement of socially and educationally backward classes and Scheduled Castes and Scheduled Tribes. |
| Article 16(4) | Provides for reservation in public employment of qualifying backward classes who are not adequately represented in state services. |
| Article 341 | Coverage of Scheduled Castes under the constitutional procedure. |
| Article 342 | Coverage of Scheduled Tribes under the constitutional procedure. |
All these provisions are of different nature. The provision of Article 16(4) deals with the reservation in public employment.
The Supreme Court also took cognizance of cases where an individual had previously converted to another religion and then reconverted back to Hinduism.
The court ruled that a determination regarding whether a person is eligible for a reservation following reconversion cannot be made simply based on their previous caste classification.
In fact, an independent determination needs to be done about whether there has been a revival of the individual’s caste identity and whether all the necessary constitutional and legal criteria have been fulfilled.
Thus, reconversion does not guarantee that a reservation right is automatically restored.
This decision is important in three respects, which can be summarized as follows,
This is a decision pertaining to a particular legal question and cannot be seen as a generic one that every person who changes his religion will lose all forms of statutory protection or entitlement.
