Assam Cabinet to Repeal 1935 Muslim Marriage Act
The Assam Cabinet has approved the repeal of the Assam Muslim Marriages and Divorce Registration Act of 1935 through the Assam Repealing Bill, 2024. Chief Minister Himanta Biswa Sarma announced that the Bill will be presented during the upcoming monsoon session of the Assembly. This decision aims to address child marriage issues and bring parity in the registration of marriages and divorces.
The 1935 Act allowed underage marriages under specific conditions and provided for voluntary registration of Muslim marriages and divorces. It authorized 94 individuals to perform these registrations. The Cabinet’s move follows its February decision to repeal the outdated Act, aligning with contemporary societal norms and legal standards. The government’s goal is to implement stricter safeguards against child marriage.
The decision has sparked controversy and criticism from opposition parties. Critics argue that the move disproportionately targets Muslims and accuse the BJP government of potential voter polarization in an election year. Congress MLA Abdul Rashid Mandal and AIUDF legislator Rafikul Islam have both condemned the action, suggesting it is discriminatory and politically motivated.
The Assam Repealing Bill, 2024, will be tabled for consideration in the monsoon session. In addition to the repeal, the Cabinet has directed that a new legislation be introduced to regulate the registration of Muslim marriages in Assam, ensuring it aligns with modern legal and social standards.
